ODC International Personal Data Protection Policy

This Privacy Policy sets out the policies that ODC International follows when collecting, processing, using, disclosing, retaining and removing your personal data under Malaysia’s Personal Data Protection Act 2010 (the “PDPA”). The Act seeks to amongst other things regulate the processing of personal data in commercial transactions and to safeguard the interests of data subjects of our customers, members, subscribers, visitors.

“Personal Data” refers to data, whether true or false, about any individual who can be identified from that data itself or from a combination of that data with other information, to which ODC International may have access. This policy may be updated from time to time to keep up with changes in statutory regulations. Do kindly check the prevailing version whenever applicable.

By subscribing, purchasing or using any ODC International products, services or campaigns, or visiting our website that submit information or communicate with ODC International (through email, telephone, our website, etc.), you have consented to ODC International collecting, processing, storing and disclosing your Personal Data in accordance with this policy.

COLLECTION AND STORAGE OF PERSONAL DATA

We store information that you have entered on our website or provided to us through other means from time to time.

The personal data processed by us may include but not limited to information concerning your personal details (such as name, age, gender, identity card number, passport number, date of birth, education, race, ethnic origin, nationality, citizenship), contact details (such as address, email, phone numbers), family information (such as marital status, name of spouse or child or immediate family), communication records with ODC International, responses to market surveys and contests conducted by ODC International, credit card or debit card information and website usage information.

ODC International only collects, uses and discloses personal data with an individual’s consent or as otherwise permitted under the PDPA or other applicable laws and regulations. In providing Personal Data to us, you warrant and represent to us that:

(a) Personal Data which you disclose to us is accurate and complete; and

(b) in the case of volunteering the Personal Data of another person to us, that you are authorized by such other person to disclose his/her Personal Data to us, and that such Personal Data is accurate and complete.

The consent of the parent / guardian is required before giving us your Personal Data if you are under the age of eighteen (18).

USE OF YOUR PERSONAL DATA

The Purposes for which your personal data may be used and/or processed include but are not limited to: –

to verify and process your personal particulars and payments.
to provide our goods and services to you.
to respond and deal with inquiries and other customer-care matters or otherwise to communicate with you.
to monitor or record phone calls and customer-facing interactions for quality assurance, training and performance evaluation and identity verification purposes.
to manage payment, billing, and accounting matters.
to send you information, promotions, updates, marketing and advertising materials about our goods and services.
to manage, develop and improve our business and operations (including our website) to serve you better.
to carry out marketing promotions and campaigns, contests, market surveys and research and personalizing your experience with us.
to conduct investigations or audits or to comply with legal and regulatory requirements.
for other purposes for which we have obtained your consent.
for any other purposes reasonably necessary, ancillary, or related to the above-specified purposes.

However, all of the above will only apply if you have registered or subscribed to such publications by registering your details with us.

DISCLOSURE OF YOUR INFORMATION

Your personal data may be disclosed to third parties such as but not limited to:
a. banks, auditors, governmental departments and/or agencies, regulatory and/or statutory bodies, courts of law;
b. credit check companies;
c. any such third party requested or authorized by you.

We will never disclose your Personal Data for any secondary purposes unless your consent has been given or if so permitted or required under the PDPA or other applicable laws and regulations. We will likewise never sell or license any Personal Data that we collect from an individual. We may also use your Personal Data to protect our rights, property, the safety of our customers and third parties.

TRANSFER OF YOUR PERSONAL DATA

By providing us with Personal Data, you agree and consent that such Personal Data may be transferred, stored and/or processed in a country or territory outside Malaysia. Data may also be generated or combined with other information available to ODC International, its affiliates, subsidiaries, associated entities and any of their branches and office (together or individually). We will, however, ensure that any party to whom we transfer your Personal Data outside Malaysia provides to such Personal Data a standard of protection at least comparable to the protection under the PDPA. This includes (without limitation) ensuring that any party encountering the Personal Data outside Malaysia:

Complies with the PDPA and accompanying guidelines issued by the relevant regulatory authorities, all applicable laws and regulations and this Privacy Policy (“Data Standards”) shall not permit anything to be done which might cause such party or us to breach the Data Standards.
Takes all appropriate measures to ensure such compliance by implementing such Data Standards as may be notified by us to them from time to time and appropriate technical and organizational measures and providing standard protection for the Personal Data that is comparable to the protection under the PDPA.
Protects Personal Data by making reasonable security arrangements to prevent unauthorized access, use, disclosure or modification.

ACCURACY, CORRECTION & ACCESS

You are responsible for ensuring that the personal data that you have provided to us is accurate, complete and not misleading and that such personal data is kept up to date. If you have submitted Personal Data to us electronically or otherwise, and would like it corrected, feel free to send us a written request to info@odcinternational.com.my. We will comply with reasonable requests to correct your Personal Data as soon as practicable.

SECURITY OF YOUR PERSONAL DATA

ODC International is committed to taking reasonable steps to ensure that your Personal Data is securely stored and protected against risks of unauthorized access, collection, use, disclosure, copying, modification, disposal or destruction.

Notwithstanding our security measures for protecting your Personal Data, we should highlight that no data transmission over the Internet is entirely secure and by providing your Personal Data to us in this manner, it is understood that transmitting this information would involve some risks.

COOKIES

As with most websites, when you visit the ODC International website, we may record anonymous information such as IP addresses (which is not used to identify a specific individual), time, date, referring URL, pages accessed and documents downloaded, duration of stay or use, type of browser and operating system.
